Warrick County board tables town–county agreement on Newburgh sewer and ditch repairs

The Warrick County drainage board on Monday tabled approval of a draft service agreement with the Town of Newburgh that would fund repairs to an eroded drainage ditch and relocation of an exposed sanitary sewer line.

A county staff member opened the discussion by saying the total project cost is $322,375 and that the estimated county contribution would be $25,500, with the town covering the remainder. The staff member said the town designed the work and would obtain permits and conduct construction while the county would reimburse the town for its portion. "My intention was to draft it in a way that just preserve the status quo afterward," the staff member said, adding he would revise language that might be read as creating new county maintenance obligations.

Commissioners and staff debated whether the draft would inadvertently require the county to assume maintenance responsibilities the plat and drainage plan allocate to property owners. A committee member raised concerns that using public funds to repair facilities on platted private easements could create an undesirable precedent. To resolve the questions, the board voted to table the item and "table to and direct Chris and I to meet with the surveyor and see what we can do," the committee member said; a motion to table was seconded and approved by voice vote. The item will return to a future meeting after staff and a commissioner meet with the surveyor and the town to revise the agreement and address funding and maintenance language.

The board did not adopt the agreement; it explicitly asked staff to produce a revised draft that clarifies whether the county is taking any new maintenance obligations and to work through possible funding options before the matter returns for further consideration.
