The Bernalillo Town Council on July 20 adopted three related resolutions to authorize partial employer “pick-up” of Public Employees Retirement Association (PERA) member contributions for municipal plans covering general employees, police and fire personnel.
Terri Gray presented the three resolutions. Resolution 07/20/2026A authorizes a 65.07% pick-up of PERA member contributions for Municipal General Member Coverage Plan 4; Resolution 07/20/2026B authorizes a 58.64% pick-up for Municipal Police Member Coverage Plan 5; and Resolution 07/20/2026C authorizes a 57.45% pick-up for Municipal Fire Member Coverage Plan 5. The resolutions cite NMSA 1978 Section 10-11-5 and Section 414(h)(2) of the Internal Revenue Code as the legal authority for employer pickup and note those employer contributions are irrevocable under the state statute except as provided by law.
Each resolution was moved and approved by roll call during the meeting; the minutes record unanimous yea votes on all three items. The resolutions include specific contribution percentages (employee contribution percentages and employer contribution percentages) and state they apply to employees within the stated PERA coverage plans. The minutes do not include fiscal projections for the town’s ongoing cost beyond the stated percent pick-ups, and the Council did not request further fiscal analysis during the recorded discussion.
