The Northern Nye County Hospital District board unanimously approved a corrected Department of Taxation corrective action plan after a legal representative outlined deficiencies in a prior contract that left the district exposed to tax and enforcement risk. Vice Chair Charles Keller called for the motion and the board voted 3-0 to accept the plan after correcting the first bullet to show the amount as $500,000.
A legal/agency representative told the board the prior loan-style agreement lacked repayment terms and an executed professional services agreement, meaning there was no effective mechanism to call a default. "Governments can't loan money," the representative said, and added that the prior structure appeared to treat compensation as something that should have been reported on 1099s. He urged issuing corrected 1099s for past payments where appropriate and said a month-to-month contract structure would satisfy Department of Taxation requirements while protecting the district.
Board members acknowledged the history and emphasized the district's goal of ensuring local medical services remain available. Sherry Harper said the board’s intent had been to preserve community care. The legal representative said he would email a corrected copy to staff and that the response to the Department of Taxation is due by the 23rd; he asked that the three members who voted sign the corrected document. The representative also offered continued legal assistance to help draft enforceable professional services contracts and to walk the district through any follow-up required by the Department of Taxation.
