RPC denies waiver that would allow accessory structures without a principal dwelling in Pembroke

The Pahrump Regional Planning Commission on Sept. 11 denied a waiver request that would have allowed existing accessory structures to remain on two Pembroke parcels without a principal dwelling. Planning staff recommended denial, citing an open code‑compliance case and the inability to identify a hardship or unusual circumstance meeting Nye County Code findings. Code enforcement reported the block shed and other structures should have gone through zoning review and that the most recent structure did not meet requirements.

Applicant Marco Dodo and his wife described building a small block structure after a theft and said health issues delayed construction of a principal residence; Dodo asked the commission, "All I'm asking is may I keep it?" Neighbors opposed the waiver, raising concerns about selective enforcement and unpermitted plumbing. Code enforcement testified the two earlier sheds were grandfathered but the added block shed required review. After deliberation a commissioner moved to deny the waiver based on the staff report; the motion passed 4–1. Staff and commissioners noted the applicant retains the right to appeal to the Board of County Commissioners.
