Council authorizes amendment to Hyatt/Hyde Creek development agreement to expand shared amenities

Brandon, a city staff member working on development agreements, and the developer’s counsel described a negotiated second amendment to the Hyde Creek development agreement (phases B1 and B2). The amendment adds additional land into the overall subdivision and allows units in the newly added phase to use and occupy expanded existing amenities rather than requiring a separate clubhouse immediately for that phase.
"This is not a new development... The original agreement contemplated 2 phases... Those plots have actually already been recorded," the developer’s counsel stated while explaining the phasing. Staff described specific amenity changes in the amendment: increasing the clubhouse from 2,000 to 2,500 square feet, adding shaped pavilions and commercial-grade playground equipment, picnic areas and pickleball courts. The staff negotiators said the amendment includes timing provisions that hold back certificates of occupancy until the agreed thresholds for amenity completion are met, protecting early residents from fees for amenities that aren’t yet constructed.
Council discussed why the amendment does not change overall density or unit counts and then authorized the mayor to execute the amendment by motion and roll-call vote.
