Council approves smaller setbacks for non‑agricultural accessory buildings in Rural Residential zone

The City Council unanimously approved Ordinance 2025-009 on June 24 to amend sections 10-6-2 and 10-9A-8 of the City Code. Community Development Director Daniel Cardenas explained the change reduces the required separation between a primary residence and accessory buildings from 20 feet to six feet for accessory structures that will not house animals or be used for agricultural purposes; structures intended for animals/agricultural occupancy retain the 20-foot standard.
Director Cardenas said the 20-foot rule originated from animal-related concerns (for example, kennels) but had been applied uniformly to all accessory buildings. The Planning Commission recommended the targeted amendment unanimously. No public comment was offered during the hearing. Council Member Cyd LeMone moved to approve; Council Member Dianna Andersen seconded. The motion carried unanimously.
The amendment does not change setbacks to property lines; it only changes the separation required between the main dwelling and an accessory structure when the accessory use is non‑agricultural.
