Commission approves Never Forgotten Animal Society CUP; waiver continued while applicant pursues state septic guidance

The commission approved a conditional use permit for Never Forgotten Animal Society to operate a nonprofit animal-rescue facility at 3091 North David Street but did not grant the requested categorical waiver at this hearing. Staff recommended approval of the CUP while recommending denial of the broad waiver; the applicant, executive director Pat Lemming, told the commission the remaining hurdle is a state commercial septic (OSDS) requirement that stems from a regional high‑nitrate designation and said she has been unable to navigate state contacts to obtain a written exemption.

Lemming said the rescue has processed over 5,000 animals in six years and asked for more time to pursue a state waiver and to avoid the expense of a commercial septic system. "What we're asking from you guys is to give us more time," Lemming said, explaining the organization requested time to pursue state approval. Many neighbors and rescue volunteers spoke in support, noting the local shelter’s limited capacity. After discussion, the commission approved the CUP subject to conditions and continued the waiver request to the January 15, 2025 meeting to allow the applicant to pursue state-level contacts and to submit any additional justification. The commission noted staff will continue enforcement and review steps and that any future relief from the state would need to be provided in writing before county code exceptions could be finalized.
