District counsel to send letter amid disagreement over maintenance responsibility for road to clubhouse

District counsel will send a letter asserting the Village of Estero owns the road west of U.S. 41 to the Clubhouse after the Village said it need not maintain it and counsel thought the County might be responsible.
Lenore Brakefield of Woodward Pires & Lombardo told the Board that the Village of Estero’s position is it does not need to maintain the road west of U.S. 41 leading to the Clubhouse. District Counsel Tony Pires said he believes the County is responsible and will send a letter to the Village and the County counsel asserting that the Village owns the road and seeking clarification.
Shane Willis noted he had emailed Johnson Engineering documents to Pires on November 20, 2024 that Mr. Pires can reference in his correspondence. The Board took no formal vote but recorded the direction to have counsel pursue the matter with local governments to resolve maintenance responsibility.
