Town Board finds Greene County community center exempt from Cairo land-use laws

The Town of Cairo Town Board voted on Aug. 4, 2025 to find that Greene County’s proposed Community Services building is exempt from the town’s land-use regulations and to authorize intermunicipal agreements to support the project.
The resolution states the proposed project is an approximately 20,000-square-foot building on an 18.088-acre parcel (tax map 83.00-4-1) in a Main Street Commercial zone and that the use is consistent with the Town’s 2008 Comprehensive Plan. The Board also authorized the Supervisor or designee to execute an indemnification agreement with Greene County and to consent to the County acting as Lead Agency for SEQRA review (Resolutions No. 2025-151, 2025-152 and 2025-153).
Supervisor Watts presented the motion, which Council Member Tim Murphy seconded; all members present voted in favor and Council Member Flaherty was recorded absent. The resolution directs the Town Clerk to file the document in the appropriate index within five business days.
The Board’s findings list legal precedents and a balancing test used to evaluate municipal immunity from local land-use rules and note that the parcel’s zoning permits municipal use. The County has declared itself Lead Agency and will undertake the SEQRA environmental review; the Town’s resolution notes the project remains subject to NYSDEC stormwater requirements, SEQRA and county public-health review.
