Fayston DRB schedules site visit after applicant seeks front-setback waiver for detached garage

Dale King told the Development Review Board he wants a garage closer to his house and requested a front-setback waiver for a detached structure. The board found application #3946 complete (motion by Mike Quennville, seconded by Ky Koitzsch) and engaged in detailed questioning about site constraints, septic leach-field locations and the position of the town road relative to the 2017 survey.

Board members raised multiple potential constraints: Ky Koitzsch observed that "the actual road position has changed since the original survey was drawn (2017)," which King confirmed; Beth Eisenhower noted that the area within setback limits contains a leach field and King pointed to an alternative leach field on the map. King said the proposed garage would sit about 8 feet from the house, the roof pitch would match the house (7/12), and the structure is detached because joining it would affect windows and interior light: "If you insisted that I connect it to the house, I probably wouldn’t build it." Zoning Administrator Jason Wilson cautioned that moving close to the leach field "could be in violation of the wastewater permit (a State permit)."

The board discussed whether attaching the structure would change how the nonconforming structure rules apply and whether narrower dimensions could allow a conforming location. Jim Donkersloot and other board members requested a site visit to verify measurements and ground conditions; the board scheduled a site visit for June 26 at 10:00 a.m. at 150 Rankin Road and asked that King stake the 65' and 45' points for the board to confirm. The hearing was continued to allow the site visit and further consideration.
