Council adopts Moss Lake ordinance changes, delays enforcement on longstanding structures

City Manager Todd Carpenter and Inspections & Codes Director Clint Houser presented proposed amendments to Chapter 92 (the Moss Lake ordinance) intended to clarify permitting, enforcement and the advisory status of the Moss Lake Commission. The presentation noted the changes would: clarify that the commission is advisory to staff, set term limits for commission appointees, require variance requests be handled by the Board of Adjustment, and clarify rules about what may be built and how enforcement would be handled.
Council engaged in extended discussion about a new subsection (92.39(o)) that would address preexisting structures currently in violation of the ordinance. Because some structures have existed for many years without prior enforcement, councilmembers asked for additional clarification. Councilmember Jimmy West moved to adopt the ordinance but table subsection 92.39(o) pending further clarification; Councilmember Jay Rhodes amended the motion to require additional information and any amendment be returned within 60 days. The amended motion passed 6-1 with Councilmember Scott Neisler dissenting.
