Board approves Eagan House rezoning, waives reading rules to finalize ordinance

The Jackson County Board of Supervisors on March 24 approved Ordinance 3-22, reclassifying parcel 440236427061000 from A-1 agricultural to C-1 highway commercial for the Eagan House rezoning.
A zoning department representative told the board the Jackson County Zoning Commission held a properly noticed hearing on Feb. 16 for case DC26-01 and "unanimously approved recommended approval of the request, subjects to conditions pursuant to Iowa code subsection 335 dev.7." The conditional rezoning would limit use to enclosed storage within the existing structure and permit a single accessory vending machine; staff recommended the property owner sign and record a memorandum of agreement with the conditions before the board hearing.
The board closed the public hearing, moved to approve the ordinance and then voted to waive Robert's Rules of Order to proceed with the second and third readings during the same session. Chair Don Swinker announced the motions carried after members responded "aye". The board did not record opposition during the public vote.
The zoning representative also said staff will record the memorandum and exhibit with the ordinance once executed. The board's action implements the zoning commission's recommendation and the conditions that "run with the land," as described by staff. The ordinance approval completes the board's review sequence for the Eagan House rezoning at this meeting.
