Staff told the commission that the Board of Zoning Appeals upheld the zoning administrator's determination that the Wattsville Battery Energy Storage System conditional use permit had expired, and that the proponents intend to appeal that ruling to the Accomack circuit court.
"The Wattsville Battery Energy Storage System ... the conditional use permit was indeed expired," the Deputy County Administrator said. "They are going to appeal that decision to the Accomack circuit court, and we're still waiting for that paperwork."
Staff framed this as an update; no action was taken by the planning commission at the informational session.
