Council approves waiver of 15-foot right-of-way dedication for South Lane Street replat

Council held a public hearing on a major-waiver request from property owner Stephanie Jimenez for a replat that would otherwise require dedicating 15 feet of right-of-way along South Lane Street. Development services staff (Wayne) told the council the existing street right-of-way is 20 feet and that dedicating 15 feet would total about 0.034 acres and reduce the lot by over 1,500 square feet, potentially dropping the lot below an 8,000-square-foot minimum and requiring Board of Adjustment review.
Staff reviewed the subdivision ordinance (subsection 4033 and Section 702.2) and recommended approval of WAV-26-003 as written; planning and zoning had recommended approval with a condition requiring a 5-foot dedication instead of 15. After questions about curbs, gutters and sidewalks (which staff said would be required with the replat) and whether reducing dedication would send the lot to the ZBA, a council member moved to approve the waiver as presented and the council voted in favor by voice vote. The council recorded the approval as adopting the staff-recommended language for item 1 (WAV-26-003).
