Hutto EDC adopts new construction contract template with performance provisions

The board approved a new construction contract template intended for use on EDC projects, a move staff said will shorten negotiation times and give the EDC clearer remedies for schedule or quality issues.
Legal counsel explained the template’s structure—general conditions, project conditions and specific performance incentives and disincentives—designed so project‑specific modifications can be made without reworking the entire document. “It has all of the desired incentives and disincentives that we have discussed,” counsel said. The board voted to adopt the template via resolution R HEDC‑2026‑625; the motion passed unanimously. Staff said adopting the template will require that any future amendments be returned to the board for approval, limiting unilateral staff changes.
