Under the revised agreement as described to the board, the Hoplin parties will conduct the cleanout at their expense and ensure the work does not exceed culvert-to-culvert, invert-to-invert grade; they will not spread spoil on the McLaughlins’ property. The McLaughlins will modify the indemnity language in the agreement and the parties will attach Moore’s exhibit documenting the limits of the cleanout. Attorney Fredricks will review the revised draft once received from the McLaughlins and will act as intermediary to provide the new draft to the Hoplin parties.
