Council conducts first readings of firearm-related code changes to align with state law

On Jan. 22 the Huachuca City Council held first readings of three ordinances intended to align municipal code with state law (A.R.S. 13-3108).
Ordinance 2026-01 would repeal a fee for criminal background checks before the transfer of a firearm to align with A.R.S. 13-3108(A). Ordinance 2026-02 would amend exceptions governing when minors may lawfully possess firearms to reflect A.R.S. 13-3108(G)(2)(d). Ordinance 2026-03 would remove a prohibition on firearms-related home-based businesses from the town’s zoning code (Title 18), again to conform to state law. Mayor Johann R. Wallace performed the first readings as recorded in the minutes; the minutes do not record council votes adopting these ordinances at the Jan. 22 meeting.
Town Attorney Thomas Benavidez is listed in the minutes as the presenting attorney for the code updates; the minutes identify the readings as first readings, which is a procedural step prior to any adoption or final vote.
