Town attorney authorized to draft ordinances to align firearms code with state law

Town Attorney Thomas Benavidez told the Huachuca City Council that several town-code provisions conflict with recent state law changes, and he asked the council to authorize preparation of ordinances to bring the code into compliance.
Benavidez identified three specific code sections for amendment: Section 18.100.210(D)(1) (Weapons Merchant Prohibited Home-Based Business Use), Section 9.20 (Minors Prohibited From Carrying Firearms) and Section 2.55.070 (Fees Chargeable By Police Before Firearms Transfer). He said the town currently prohibits some conduct that state law now allows and requested authorization to draft the ordinance language.
The council voted to authorize preparation of the ordinances; the motion was moved by Johann R. Wallace and seconded by Christy Hirshberg and passed unanimously. No ordinance text or effective date was provided at the Jan. 8 meeting.
