Brown County APC approves one-lot minor subdivision at 8812 Sweetwater Trail

The Brown County Area Plan Commission approved a one-lot minor subdivision for property at 8812 Sweetwater Trail in Nineveh during its March 24, 2026 meeting. The commission voted unanimously to grant petition 26-P-01, clearing the way for the parcel owners to apply for a building permit.
Director Kayla Robertson read the staff report describing the petition submitted by William and Julia Smith and represented at the meeting by Conner Barnette of Foresight Land Surveying. Robertson told the commission the parcel as recorded in 1980 does not meet the commission's current 3-acre minimum because the Subdivision Control Ordinance took effect in 1978; under the ordinance the parcel requires approval as a minor subdivision to be a legal, buildable lot. Barnette said the existing 2.04-acre lot meets zoning setbacks, septic approval is in place, and electric service was approved, and that the petitioners are ready to pursue a building permit once the subdivision is authorized.
Commissioner Jane Gore asked about notification; Robertson reported 11 certified letters were sent and 8 were returned. Commissioner Andy Voils moved to approve the docket as written, Randy Jones seconded, and a roll-call vote recorded Bowden, Allen, Gore, Jones, Hammes, and Voils voting yes. The motion carried and the minor subdivision was approved.
Next steps for the petitioners include filing for a building permit and any required inspections; no appeals or further conditions were recorded in the meeting minutes.
