Fremont County P&Z backs C1 rezoning for Eck property despite easement concerns

The Fremont County Planning & Zoning Commission voted unanimously May 26 to recommend approval to the Board of County Commissioners of a zone change for 3783 and 3784 Blue Heron Lane (application #26-012), changing the parcels from Commercial Limited Office to Commercial Neighborhood (C1). Commissioner Michael Pauly moved for recommendation; JC Siddoway seconded, and the motion passed by voice vote.
Staff (Sara Bowersox) explained the zone change would allow the applicants to pursue a Conditional Use Permit for a campground, noting the property sits in an area the county's Preferred Land Use Map designates as Commercial and that a zone change does not itself authorize a specific use. Attorney Robert Harris, representing an adjacent property owner, asked the commission to delay recommendation because he argued the application lacked required Class II materials and that unresolved easement rights and a narrow (16-foot) road could prevent safe access. Harris said, "we would ask that the commissioners recommended denial until those issues are resolved." The applicants responded they would address access and road improvements as required; Mike Mellancamp told the commission they had followed previous direction to pursue C1 and said the site had been used under a temporary county permit with no complaints.
