Council declines to take up proposed North Iowa/Northeast street closure after members raise concerns about dangerous buildings

City planning staff presented a request to close and vacate an L-shaped parcel of right-of-way along North Iowa Street and Northeast Street, explaining the applicant had provided appraisals and money in escrow and that utilities would need to be located and relocated at applicant expense.

Council members raised objections because the subject property includes two dangerous buildings the city is preparing to address. The mayor and several council members questioned why the city would be willing to sell additional property to an owner with existing dangerous-building issues. Staff said there is no city policy that would categorically prevent processing a closure application in that circumstance and said the applicant had followed the required process, but staff agreed to seek clarity about the property owner's plans and the status of building remediation.

When no council member made a motion to approve the closure, the agenda item died for lack of motion. The mayor noted, "If there's no motion, it dies," and staff confirmed they will seek further information about the buildings and the applicant's development plans before returning an item for council consideration.

The matter will be revisited only if the applicant completes required steps, including utility location/relocation work and any remediation of dangerous buildings as appropriate.
