Commission postpones rezoning request at 720 West K Street, cites spot-zoning concerns

Johnna Matthews, planning staff, reviewed the parcel history and noted that although the comprehensive-plan future land use map shows medium-density residential, city records indicate the lot has been zoned general commercial for at least 13 years. "Staff recommends that you tell us what you want to do — do you want us to look at the larger area to see if general commercial is appropriate?" Matthews asked the commission, requesting direction. Commissioners discussed the need to perform an annual or broader zoning-map review and to involve neighbors in a possible larger-area analysis.
Given the potential legal concerns about spot zoning and the complexity of the surrounding uses (including nearby cemetery and utility properties), the commission moved to postpone the item indefinitely and directed staff to consult with the applicant and consider a broader review of the adjacent area before bringing a recommendation back to the commission.
