Council authorizes "friendly condemnation" to acquire Parcel 5 for Bryce Road bridge replacement

Johns Creek council approved a resolution authorizing the use of the city's eminent-domain authority to acquire Parcel 5 needed for the Bryce Road bridge replacement project, described in staff materials as a "friendly condemnation" to facilitate negotiations with a homeowners association.
Attorney Couch explained staff had resolved acquisitions for two of three parcels required for the bridge project but needed authority for Parcel 5 to bring all stakeholders to the negotiating table. "This is what we sometimes call a friendly condemnation so that we can actually get all of the stakeholders in one place to try and perhaps negotiate it once the condemnation has been filed," Couch said. Staff noted the parcel is owned by a homeowners association and that condemnation would allow the HOA to negotiate on behalf of members.
The council moved and approved the resolution by voice vote. Staff said the bridge project will proceed with property acquisition and that the city will continue working with Fulton County and regional partners on project sequence and funding.
