Geneva County approves sale of landfill parcels to Green Canyon Environmental

The Geneva County Commission approved the sale of the operational C/D landfill and the adjoining inactive sanitary landfill to Green Canyon Environmental, LLC, at a purchase price of $6,500.00 per surveyed acre. County Attorney Phil Eldridge told the commission the buyer exercised its option to purchase both parcels, has formed an Alabama LLC for the purchase, and intends to assign the agreement to Arena Tire Processors LLC. Eldridge said the buyer's due-diligence period was extended through March 13, 2026, and the closing packet had been received though survey completion and proof of county ownership of Landfill Road (claimed as a prescriptive right-of-way in continuous use since 1974) remained pending.
Commissioner Todd Brannon moved to adopt the resolution approving the sale and authorizing Chairman Toby L. Seay to sign all necessary closing documents; Commissioner Bart Wilks seconded and the motion passed 4-0. Commissioners also voted 4-0 to obtain closing-protection insurance because the closing agent is located in another state. Attorney Eldridge said funds from the sale will be wired at closing and described the buyer's requests and the county's attempts to provide case law showing prescriptive right-of-way precedent.
