Staff said the city must consider whether to limit duplexes as a percentage of housing stock. "Some cities wish to cap or limit the number of duplexes allowed... A recent bill has changed," staff said, referring to Kansas Senate Bill 418, the By-Right Housing Development Act.
Commissioners and public commenters discussed whether SB 418 entirely prevents caps or whether exceptions exist for cities with constrained utility infrastructure. A public commenter urged the commission to check the bill text at kslegislature.gov and noted the city may qualify for exceptions because of near-capacity sewer constraints. Staff said the city attorney will review the bill before the commission takes final action.
