State agency issues preliminary OK for Arrowhead Landfill air permit modification

The Alabama Department of Environmental Management said on Nov. 18 that it has made a preliminary determination to modify major source operating permit number 107-0003 for the Arrowhead Landfill, which would increase the facility's design capacity and make it subject to federal new source performance standards.
"Perry County Associates LLC has submitted an application to modify its major source operating permit number 107-0003 for the Arrowhead Landfill," John Robert Gill, Environmental Engineering Specialist Senior in ADEM's air division, told the public. Gill said the federal standards were developed by the U.S. Environmental Protection Agency and that ADEM implements those rules in Alabama.
Gill said the MSOP is intended to consolidate existing air pollution control requirements and "does not authorize any increased air emissions or new emission sources." He also said compliance with the proposed permit conditions would not result in violations of applicable air quality standards designed to protect human health and the environment, and that the department's preliminary determination will be reconsidered after all comments are received and reviewed.
ADEM emphasized that, in reviewing the application, its authority is limited to air-quality issues. Gill told the hearing the department "may consider only comments relating to air quality in its final decision on this request for a modified major source operating permit." Other concerns raised by residents at the hearing—such as noise, traffic or property values—are outside ADEM's permitting authority, he said.
The department is accepting written comments until the close of the public comment period; Gill said the statement of basis and draft permit were made available to the public on Oct. 10, 2025. The agency will post its response to comments and the final permit determination to its e-file system after reviewing the hearing record.
