Because the FAA treats aspects of the planned facility as aeronautical, staff said the FAA requested a small descriptive business plan be added to the ground lease (as a new section 1.5) to clarify aeronautical uses before permitting vertical construction.
County legal staff and the airport team recommended that the board authorize continued negotiation and development of the lease amendment so it can be submitted to the FAA; the FAA provided a 60‑day window for modification. The board approved a motion to authorize continued negotiation and directed staff to return with the finalized amendment for execution after attorney review and further FAA comment.
Staff emphasized the change is procedural and that final execution will come back before the board for formal approval.
