Council approved two related developer agreements for the Hyatt Creek subdivision: a reimbursement agreement to compensate a developer for the difference between a standard utility installation and city-required upsized utilities, and a connectors (pioneering) agreement that is recorded against adjacent properties so future developers pay their pro rata share when they connect. Staff explained the reimbursement is intended to fund system improvements (for example, paying the difference between an 8-inch and a 12-inch main) and that the connectors agreement will expire if adjacent properties do not develop within the agreed period (20 years for connectors agreements per recent code amendments).
"We get the invoices from the developer themselves, and Travis goes over the numbers," a staff speaker said, explaining that staff verifies costs and may call contractors for market comparisons if prices seem unusually high. Staff said reimbursed amounts would be paid on an annual cycle tied to the impact-fee analysis and that planned reimbursement payments would likely occur in October 2027.
