Council tables proposed changes to business licensing, citing appeals concerns

The American Fork City Council on March 10 tabled an ordinance that would revise Chapter 5 of the city code governing business licensing, including application requirements, fees, appeals and revocation procedures.
Council Member Tim Holley raised technical and policy concerns during the discussion, saying, "In 5.04.090 in paragraph two, I thought it was missing a semi colon; I thought those were supposed to be two separate items." Holley also objected to removing the council from the appeals process, arguing the change would take the legislative body out of decisions he believed it should review.
Legal Counsel Heather Schriever told the council the proposed revisions were intended to "remove the legislative body out of the appeal process" and to treat issuance of a business license as an administrative act, with final appeal available in district court. She said staff had found three different appeal avenues historically and recommended streamlining to reach resolutions faster.
After discussion, Council Member Ernie John withdrew his prior motion to adopt the ordinance and moved to table the item for further review; Council Member Staci Carroll seconded. The motion to table passed unanimously (Carroll, Holley, John). The item will return to a future work session or council meeting for further consideration.
