Ward County approves zoning ordinance language on first reading and vacates an outlot
Summary
On first reading April 7, 2026, Ward County commissioners approved amended language to Ward County Zoning Ordinance 2026-1, authorized an amendment to Article VIII Section 8.04(1), and approved a vacation of Outlot 1 for applicant Richard Foss.
Beth Pietsch, Planning Administrator, presented planning commission recommendations and proposed ordinance language changes. The commission voted to approve amended language to the Ward County Zoning Ordinance 2026-1 on first reading, and separately approved an amendment to Article VIII, Section 8.04(1). The final approval of the original motion with the amendment passed by roll call; Commissioners Merritt and Schuler recorded no votes on that specific approval.
Applicant Richard Foss requested vacating Outlot 1 (portion of SE of Sec 18-151-84, Spring Lake Township), explaining the parcel is no longer used residentially and is now agricultural; the Planning Commission recommended approval and the county commission approved the vacation based on staff findings of fact.
Commissioners also discussed application fee changes for planning and zoning and moved to set the conditional use permit fee at 3% of total construction cost with a $1,000 minimum to be paid at application; that amendment and the adopted fee schedule passed by roll call.
