Finance director: $200,000 to be transferred from general fund into tort fund to pay legal bills

Audrey Tipton, Shelby County Director of Administration and Finance, told the commission that the appropriation to support potential litigation will be executed as a transfer from the general fund into the tort fund, which is the county’s established mechanism for paying legal defense costs.
"Currently, the money is in the general fund and we will move it over to the tort fund," Tipton said when commissioners asked where the $200,000 would come from. County Attorney Megan Smith added that litigation expenses of the county are contemplated within liability funding policy: "The expenditure being proposed here is from the tort fund," she said. Tipton explained the transfer shows the outflow from the general fund and an offsetting entry into the tort fund to cover legal expense at year end.
Commissioners pressed for specifics about which projects might be delayed or what the county would forgo to fund litigation. The finance director said the county could adjust project timelines and that the transfer mechanics are consistent with the county’s budgeting and tort-fund true-up processes.
The appropriation passed 8–3; staff said further administrative accounting steps will be required if counsel is retained.
