County Attorney Doug McNett reviewed Kansas statutes (68‑516, 68‑1701, 68‑1703 and 68‑1704) explaining that county designation is required to pursue certain federal grants and major road improvements.
Public commenters questioned who would pay long‑term maintenance costs after adoption and raised environmental concerns tied to a proposed feed yard. Steve Walters asked whether the county had a plan to require the feed‑yard applicant (ILS) to pay for future maintenance; County Attorney McNett said permitting through the State of Kansas limits Pawnee County’s ability to impose a Road Use Agreement. Commissioner Rein said the county would obtain the Kansas Department of Commerce cost‑benefit analysis for public review and stressed the nature of the action: 'Roads are not being built, they are being improved.' The motion to adopt the resolution, moved by Burdett and seconded by Miller, passed 3–0.
The resolution enables the county to apply for federal funding and to include the roadways in county maintenance schedules; the county will provide the Cost Benefit Analysis to the public when available.
