WCD briefs MLAC on bills including HB 4040 and imminent rulemaking changes

Teri Watson, MLAC staff, summarized recent bill activity for the Workers' Compensation Division. She said SB 1519 (temporary total disability) had passed both chambers and was headed to the governor with an effective date of Jan. 1, 2027; HB 4027 (BOLI expense fund) had passed and would take effect 91 days after sine die; and HB 4040 (granting full attending physician status to nurse practitioners and physician associates) was in the Senate for third reading and included an emergency clause.
WCD Administrator Matt West explained the practical implications if HB 4040 is enacted: the division would issue temporary rules in divisions 9, 10, 15, 30, 35 and 60, starting 180‑day clocks for permanent rules, and convene a stakeholder rules advisory committee within six months to guide permanent changes. He emphasized WCD will communicate updates and that rule changes would require immediate work from policy analysts once the bill is signed.
