Howard County hearing examiner Catherine Taylor told petitioner Timothy I. Martins on the record that she plans to approve his request to regularize the side setback for an existing garage at 10688 Harding Road. Taylor said the current measured setback reads about 6.1 to 6.3 feet, short of the standard 10-foot requirement and of a previously granted 7-foot variance noted in the file.
Timothy I. Martins, who was sworn before giving testimony, acknowledged he built the garage and said he “was totally in the wrong” for not having accurate as-built measurements initially. He told the examiner he later obtained a professional boundary/location drawing and submitted it to the county. Taylor said she would draft a written decision and that the county has up to 30 days to issue the order.
Taylor explained that the hearing is the forum for the petitioner to present facts and that she would weigh the record against the variance criteria. She emphasized that any approval will be effective only after issuance of the written decision by the county’s office. Martins confirmed he wants to bring the garage corner into compliance and is not seeking to change property lines or add to the garage at this time.
