Council releases right of first refusal and approves sale of Commerce Center lots to enable property transfer
Summary
Council adopted Resolution No. 2026-02 releasing its right of first refusal on Commerce Center Lots 18 and 19, issued an estoppel certificate to TRC Investments, and then adopted Resolution No. 2026-03 approving sale of the same lots; staff prepared documents to permit TRC to sell to Landmark Precast.
Council took a sequence of actions to clear title and permit a sale at the City of Okeechobee Commerce Center. Council Member Jarriel moved and Council Member Chandler seconded to adopt Resolution No. 2026-02 releasing the City's right of first refusal for Lots 18 and 19 and the vacated roadway and cul-de-sac between Lots 17–20; Assistant City Attorney Stephen Conteaguero read the resolution title into the record and the motion carried unanimously.
Separately, Council Member McAuley moved and Vice Mayor Clark seconded to issue an Estoppel Certificate letter to TRC Investments, LLC for Lots 18 and 19 and the vacated roadway/cul-de-sac. That motion carried unanimously. An item added to the agenda, Resolution No. 2026-03, was then adopted (motion by Vice Mayor Clark, seconded by Council Member McAuley) to approve the sale of Lots 18 and 19 and the vacated road/cul-de-sac in the Commerce Center. Assistant City Attorney Conteaguero indicated staff prepared and submitted documents requested by the title company and that those items will allow TRC Investments to sell the Commerce Center property to Landmark Precast. The actions were recorded as presented in Revised Exhibits 8–10 and entered into the official minute file.
