Newbury hears TRORC briefing on Act 250 Tier 1B; March opt-in deadline announced

The Newbury Selectboard met with Two Rivers Ottauquechee Regional Commission staff on Feb. 11, 2026, for a briefing on changes to Vermont's Act 250 and the Town's options for opting into the new Tier 1B designation. Pete Fellows, GIS manager at TRORC, said that since 2024 all Vermont towns have been exempt from Act 250 for projects under 50 units and that Tier 1B would continue those exemptions while imposing built-in controls such as infrastructure and access requirements.
Fellows said the Town may opt in either for designated village centers or for entire village areas, and confirmed that housing developed under Tier 1B could include units at any income level and may incorporate commercial uses. He told the board that the deadline to decide whether to opt in is in March and encouraged officials or residents with further questions to contact TRORC. The special meeting adjourned just before 7:00 p.m.
