The Planning and Zoning Commission voted 7‑0 to close the public hearing and approve a specific‑use permit for a drive‑through restaurant proposed at 1700 North Custer Road, known in the application as Small Sliders. Jake Bennett, a city planner, described the Unified Development Code setback requiring 200 feet from speaker equipment to single‑family zoning and explained how staff measured the speaker box distance relative to a common area lot line and the adjacent residential lots.
"The unified development code requires a setback of 200 feet... The closest speaker box is located approximately 100 feet from the adjacent property line... Including the width of the common area, the speaker box is approximately 260 feet from the closest residential lot line," Bennett said. Applicant Jake Razzle of Citadel Development said the SUP was requested only because of how the code measures setback distance and that the wooded common area and floodplain will effectively buffer the homes. The commission recorded a unanimous vote to approve the SUP; staff said the item will be forwarded to city council for final action on Sept. 16, 2025.
