TABC readopts two rule chapters and approves publication of amendments, including hemp consumption ban proposal

The commission readopted TAC chapters 37 and 39, approved publication of an amendment to §41.12 (allowing written warnings without hearings), and approved publication of a proposed rule to prohibit consumption of consumable hemp products where alcohol consumption is already prohibited.
On March 24 the commission completed a routine rule review and moved several rule proposals forward for public publication.
Senior Counsel Matthew Cherry said staff reviewed TAC chapters 37 and 39 under the Administrative Procedure Act and recommended readoption because the reasons for adoption still exist. Commissioners voted to readopt the chapters with no public comments recorded.
Cherry also presented a proposed amendment to 16 TAC §41.12 to add a subsection authorizing the agency to issue a written warning for missed compliance reports without an administrative hearing; staff said the proposal was discussed with stakeholders on Feb. 5 and recommended publication. The chair and commissioners described the issue as primarily factual (a report was filed or not) and voted to publish the amendment.
In a separate rule proposal, Cherry presented a new proposed rule (noted as 16 TAC §35.7) that would prohibit a permittee from allowing consumption of consumable hemp products on premises where alcoholic beverage consumption is generally prohibited (examples given: convenience and package stores). Staff reported stakeholder outreach on Feb. 5 and recommended publication; the commission voted to publish the hemp rule proposal for comment.
All three actions moved the items to formal publication and public comment stages; the transcript shows no final adoption of the new hemp rule at this meeting.
