Council grants Hart's Mill Road fence variance after resident cites privacy, safety concerns

Applicant Cynthia Jo Burkhardt, who lives at 1955 Hart's Mill Road, told council that storm damage in February left roughly 90% of her fence in need of repair and that traffic patterns and excessive pedestrian access to her yard have eroded privacy and caused stress for family members with medical conditions. She and supporters asked the council to allow reconstruction of the fence in substantially the same location and with the same height and transparency percentage.
"All we're asking is to be able to put the fence back in the same place, same height, same transparency percentage," Burkhardt said, describing damage from 40–69 mph microburst winds and “complete strangers” walking through their yard. Her landscaper, Mike Fridner, and neighbor Patrick Bentley also spoke in favor, noting heavy traffic and repeated intrusions. Council moved to approve the requested variances subject to the site plan received 05/27/2025 and recorded a unanimous vote.
The council's vote included a condition that construction substantially conform to the planning-department site plan; staff will review permits and compliance during the construction and inspection process.
