Board schedules adjudicatory hearings, accepts consent agreements and proposes revocations in complaint cases

The Maine Board of Pharmacy advanced multiple disciplinary matters at its March 5 meeting, accepting one proposed consent agreement and scheduling adjudicatory hearings for others with significant recommended outcomes.
The Board accepted a proposed consent agreement for case 2025-PHA-21027. For initial complaint 2026-PHA-21215, Nicholas Haar moved to schedule an adjudicatory hearing and to offer a consent agreement that would include: (1) admission to violations of 32 M.R.S. § 13742-A(1)(A), 10 M.R.S. § 8003(5A)(A)(10) and Board Rule Ch. 30(1)(14); and (2) revocation. The motion was seconded by Abdifatah Ahmed and carried with Emmons, Hamilton and Kane in favor; Complaint Officer Eric Norberg abstained and McCormack was absent.
For case 2026-PHA-21226 the Board accepted an interim consent agreement and then voted to schedule an adjudicatory hearing, offering a consent agreement that included admission to the same cited statutes, reprimand and revocation. The votes on these disciplinary items show at least one formal abstention by the Complaint Officer on matters where consent agreements or revocations were proposed.
Next steps: scheduling and notice requirements for adjudicatory hearings will be handled by Board staff consistent with administrative rules; where consent agreements are offered, the agreements — if accepted by respondents — would replace formal hearing outcomes.
