Agner said part of the property was purchased with FAA funds and that legal disputes with previous owners over easements have persisted for years. "When FAA buys something with money, they expect to get what they get from that money," Agner said, explaining that litigation and unclear easement history have constrained the airport’s ability to rely on a single existing road and have required the airport to consider building its own access.
Agner told the board the airport could implement gates and other security measures for whatever access is ultimately used and that airport counsel is involved in the ongoing legal work to resolve easement questions. The board and staff took note of the litigation reference while clarifying that issuance of the county approval letter will be contingent on required permits and staff review.
