At the Carbon County Administrative Hearing Officer meeting on July 7, 2026, Hearing Officer Nick Totten opened consideration of a zoning variance request for parcel 2-1129-000 at 590 South 400 East. The applicant, Doris Johnston, said she purchased the property about "a year and 0.5 ago," moved a modular onto the lot and later learned the current placement may not meet county setback requirements. Johnston told the hearing the building currently sits about 30 feet from the road and roughly 12 feet from the back lot line on the north side and that the lot’s small size creates an unnecessary hardship.
Johnston described personal circumstances and investment as part of her hardship case, saying, "We're just, like, living with friends at the moment," and that the modular is intended as the household residence. County staff confirmed the recorded lot dimensions as 50 feet (north–south) by about 153.6 feet (east–west) and explained that the property is a corner lot with two front yards, which affects how front- and rear-yard setbacks are measured. Hearing Officer Totten warned that placing a structure near the north property line could limit a neighbor’s ability to build a compliant garage in the future. Totten said he would review the ordinance and hoped to issue a response by the end of the week or the first of the next week.
