Dorset Zoning Board approves variance for 41 Church St. to allow spa conversion and accessible rear entry

The Dorset Zoning Board of Adjustment approved a variance for 41 Church St. at its Jan. 20, 2025 meeting, voting 7-0 to allow a reduced east side-yard setback so the property can be converted from a gallery to a spa on the first floor with an owner-occupied apartment on the second floor. Ruth Stewart moved to approve the application and Martha Merwin seconded; the motion carried unanimously.
Applicants Todd and Mike Beyer presented the application on behalf of owner Brian Hart. Todd Beyer told the board the change in use requires a new rear entry and noted that the new rear entry is "accessible." Board member Bruce Ketcham reviewed criteria 1, 2, 3, 6, 7 and 8 of Table 4-03 of the zoning bylaw and reported that the board found those criteria were met. Approval was conditioned on obtaining a wastewater permit and on subsequent approval by the Design Review Committee and the Planning Commission. The board recorded no abstentions or recusals.
