The Dorset Planning Commission voted unanimously to approve the Design Review Committee’s recommendations for a zoning application submitted by Beyer Architects & Engineers for 41 Church St.
The application proposes changing the building’s use from an art gallery to a mixed‑use property with an apartment on the second floor and a spa on the first floor. Kit Wallace, a Planning Commission member and DRC participant, summarized the proposed new rear entry and said the project will require a variance from the Zoning Board of Adjustment because an east‑side setback is pre‑existing and non‑conforming. Todd Beyer provided additional information about parking and septic considerations and Michael Beyer confirmed the property owner is not requesting additional water capacity at this time because of the town’s moratorium on new water supply loads.
Commissioners reached a consensus that the project requires one parking space. Conor Welch moved to approve the design issues reviewed by the Design Review Committee; David McAneny seconded the motion, which carried 7‑0‑0. The commission’s approval was limited to the design items reviewed by the DRC; the DRC asked for additional architectural details for the new rear entry and a lighting plan with fixture specifications to be submitted as follow‑up documentation.
The approval addresses the design issues before the commission but does not resolve the setback variance, which must be sought separately from the Zoning Board of Adjustment. The minutes record that the DRC’s conditional requests (architectural details and a lighting plan) are to be supplied to Planning staff for further review. The project’s next procedural steps in town records are the variance process (if pursued) and any building/permitting work subject to zoning and health requirements.
