Staff said the applicant provided 1,484 square feet of fenced outdoor play space, exceeding the code requirement of 1,400 square feet for 13 children. Ruiz recommended approval subject to compliance with the Child Care Division and other State requirements.
Applicant Kayla Marker told the Commission she has temporary State licensing while she corrects a few items in her handbook and installs a lock on a cellar door; the temporary license is effective until May 13, 2026. Marker said she and one staff member have completed CPR and food‑handler training and that the operation has already begun caring for up to six children. “The temporary license is effective until May 13, 2026,” Marker said, and she added she would call the licenser for a reinspection once fixes were completed.
Commissioners asked about age ranges and supervision requirements. Marker said the proposed program will serve children from 6 weeks to 12 years (including after‑school care) and that with two staff members she may supervise up to three children under 24 months but currently plans for two. The public hearing attracted no speakers in support or opposition.
Commissioner Mary Ward moved, with Commissioner Margo Piver seconding, to adopt the staff findings and approve the Conditional Use Permit with the stated state‑compliance condition. The motion was recorded as unanimous among voting members present; the minutes state the motion 'carried 4‑0.' The permit approval requires Marker to provide documented proof of State certification to the Planning Department before operating at full capacity.
