Chairman Hawk told the committee HB2359 is a cleanup bill targeting gaps in last year’s vape-product statute. He said it closes a synthetic‑nicotine loophole that manufacturers exploited and moves enforcement and fine authority to the Alcoholic Beverage Commission (ABC), explaining: "This covers that... and it also moves enforcement to the alcoholic beverage commission, clarifies that fines for violations are issued by the ABC."
Committee members did not raise substantive objections and the vote to send HB2359 to the Judiciary Committee was recorded as 21 ayes, 0 nays.
Sponsor Hawk framed the bill as strengthening public-health enforcement by clarifying product definitions and enforcement authorities.
