Planning Commission heats up over proposed trail language and ADU rules; no votes taken

During public comment and the commission’s review of a revisions list, several residents and commissioners voiced opposition to specific draft changes to the Fayston Land Use Regulations. Woody Dugan attended to present a letter from the Fayston Conservation Commission; Michael Duell read the letter aloud. Woody told the commission, “If you have not read the letter, I came in order to be able to address any questions you had about it.”
Carol Chamberlain raised several concerns, asking whether the RPC, the Brattleboro Land Conservancy Trust (BLCT), or the town attorney had reviewed the new language. She urged caution about including ATVs in trail definitions and questioned whether a road should create a natural subdivision. Commissioners noted they plan to seek legal review when language is more finalized and flagged the use of the mandatory term “shall” in standards as problematic for implementation.
The Planning Commission reported it could not reach agreement during the meeting on the three trail items and will continue work on the revisions list at its next meeting; no votes were taken on the bylaw amendments.
