Sheriff’s Office clarifies detention process, ICE pickup rules and reports impound overflow after property seizures

At the Feb. 5 meeting, the Sheriff's Office addressed what the minutes call "misinformation" regarding custody of an undocumented person at the Price County Jail. The minutes state the individual is scheduled for plea and sentencing; the Sheriff's Office said U.S. Immigration and Customs Enforcement (ICE) typically will not pick up an individual until the case is adjudicated and the person is released. The minutes further explain that ICE may issue a detainer requiring the Sheriff to hold the individual for up to 48 hours after release. The office said it is following the 14th Amendment, the Wisconsin Constitution, and Wisconsin statutes on bail and the Victim’s Bill of Rights.
Separately, the Sheriff's Office reported a court-ordered execution of judgment that resulted in seized property and several abandoned vehicles being sent to auction, which led to impound-lot overflow. Some overflow property was transferred to the City of Phillips; the Sheriff's Office said it is exploring expanded impound storage and additional cameras, lighting and fencing to secure seized property. The minutes also note the attorney general is assisting with prosecution for charges arising from an accident at Highway 111 and Highway 13.
