Kevin Walder, the rules team manager, briefed the board on current rulemaking activity and timelines, noting 14 open rules projects in various stages. He described a recently filed CR101 to implement engrossed House Bill 1941 to allow agricultural cannabis cooperatives and said the informal comment period runs through July 3.
Walder also outlined timelines for fee-related rulemaking implementing House Bill 2681 (comment period through June 23 with a planned CR103 filing after the July 1 board meeting), ongoing evaluation of retail management agreement rule drafts (referencing an engrossed substitute bill number discussed at the meeting), and expected CR103 adoption of advertising rules implementing Senate Bill 5206 following stakeholder refinements. He told the board the economist performing a small-business impact analysis for the alcohol product-placement rule sent about 1,200 surveys and had roughly a 10% response rate, which he described as typical for government-to-business surveys.
Walder said the board is monitoring federal rescheduling developments for medical cannabis and potential broader rescheduling but that there did not appear to be immediate regulatory implications for LCB rules; staff will continue to monitor federal activity and coordinate with other agencies where necessary.
Board members had no substantive questions for the update and indicated they would return to the advertising CR103 later in the meeting.
