The Senate Judiciary & Rules Committee voted to send H 581 to the floor with a do pass recommendation. Senator Nichols said the bill "restored clarity to the separation of powers" by creating a formal process for the Legislature to notify the Idaho Supreme Court via resolution when it believes a court rule conflicts with statute.
Some committee members expressed unease about the change. Senator Wintrow asked whether the bill would prohibit informal contact with the courts; Senator Nichols answered it would "simply create a formal notification process." Senator Ruchti said he was uncomfortable with the proposal and would not want the Supreme Court to weigh in on how the Legislature conducts its business. The motion passed by voice vote; Senators Wintrow and Ruchti asked to be recorded voting nay.
